Terms

Bluff IT operates under the following terms and conditions:

Payment and Invoicing

  1. Bluff IT invoices in arrears on a monthly billing cycle with a payment date of the first 20th of the month following invoice.
  2. Unless otherwise agreed, all work is performed on a Time and Materials basis on a standard hourly rate.
  3. For projects taking longer than a month, and unless otherwise agreed, progress payments will be levied against a project.
  4. Any invoice queries must be instigated within 7 days of invoice' receipt.
  5. Unless agreed in writing by Bluff IT, payment for work comissioned by a limited liability company becomes the personal liability of the directors of that company in the case where that company ceases trading or is liquidated prior to meeting its obligations to Bluff IT.
  6. Prompt payment is appreciated, and late payment may result in:
    1. refusal to take on any additional work from the offending client;
    2. the application of interest charges on monies owing;
    3. the suspension of any ongoing services provided to the client;
    4. legal action to recover monies.

End User Testing

  1. Unless otherwise agreed, the responsibility for end user testing a software product is upon the contracting client.

Intellectual property

  1. Unless otherwise agreed, all custom developed software artifacts and project related documenetation, as they come into existence, become the property of the contracting client. 

Warranty & Indemnity

  1. Bluff IT commits to using its best endeavours to ensure the quality of its products. However, the contracting client indemnifies Bluff IT from any losses incurred through the use of any custom software it has developed, or service that it hosts.
  2. A 12 months, no cost, warranty on any coding defects is provided with any custom developed software product, and comes into effect on issuance of any final invoice. Warranty will be voided if code has been tampered with by the contracting client or their nominee without the authorisation of Bluff IT.
